The bystanders who have lied to the police can be charged with Obstruction of Justice by Lying and Deceit (with “misdemeanor enhancement” it becomes a Class H felony, punishable by 4 - 30 months in prison) and Resisting, Delaying or Obstructing an Officer (class 2 misdemeanor, punishable by 1 – 60 days in jail). Both Desmond and Roman are both 14 years old so they are taken into custody on Secured Custody Orders. They go to court where the judge can hold them in “jail” until their case is heard.
Roman is charged with Conspiracy to Commit Common Law Robbery for Nathan’s bike (class G felony, punishable by 8 – 47 months in prison), Simple Assault for the assault on Nathan (class A1 misdemeanor, punishable by 1 – 150 days in jail), Simple Affray (class A1 misdemeanor, punishable by 1 – 150 days in jail) and Disorderly Conduct by Disrupting Students (class 2 misdemeanor, punishable by 1 – 60 days in jail).
Desmond is charged with Assault on School Personnel for the assault on the teacher (class A1 misdemeanor, punishable by 1 – 150 days in jail), Conspiracy to Commit Common Law Robbery (class G felony, punishable by 8 – 47 months in prison), Common Law Robbery (class G felony, punishable by 8 47 months in prison), Simple Assault for the assault on Nathan (class A1 misdemeanor, punishable by 1 – 150 days in jail), Simple Affray (class A1 misdemeanor, punishable by 1 – 150 days in jail), Disorderly Conduct by Disrupting Students (class 2 misdemeanor, punishable by 1 – 60 days in jail) and Obstruction of Justice by Lying and Deceit (w3ith “misdemeanor enhancement” it becomes a Class H felony, punishable by 4 – 30 months in prison).
School
Be aware of what your school’s policy is on this issue, because some schools have a zero-tolerance stance on such behaviors. Assault on School Personnel suspension would occur and expulsion could result.
Medical
Nathan's wounds were mostly bruises and scrapes, which healed slowly after several days. The teacher's face was badly bruised, but no permanent damage was done.
Emotional
Imagine how this experience might affect each of the people involved, including the victims, the perpetrators, as well as their family and friends. Different people are affected differently.
If you or a friend are being pressured to be in a gang, make sure you tell someone you trust (such as a teacher, family member, friend, police officer). Gangs are not the only way to “fit in.”
