ADA Complaint Procedure
This grievance procedure is established to meet the requirements of the Americans with Disabilities Act (ADA) of 1990.
Who May File
Any individual who has attempted to access one of the City's services, activities, or programs, and who believes that they have been discriminated against based on a disability.
The Complaint
The complaint may be in writing, or you may request an in-person interview with the ADA Compliance Officer. The Compliance Officer may assign the matter to their designee for investigation.
The complainant should have information readily available for the investigator. Information should include contact details and all relevant facts of what occurred. Relevant facts include, but are not limited to, location, date, time, any interactions with City employees, names, and other pertinent information.
The complaint should be made as soon as possible, but no later than 30 calendar days from the date of the alleged violation to the Compliance Officer.

An intake interview will be scheduled, and an investigation of the allegations will be conducted. Following the investigation, a report and recommendation will be provided to the Compliance Officer. A determination will be prepared in writing and mailed certified to the complainant, and a copy will be provided to the City Attorney’s Office.
Appealing the Decision from the Compliance Officer
If the complainant wishes to appeal the Compliance Officer’s decision, they may do so, in writing, to the City Manager within 30 days from receipt of the decision.
All investigative files will be archived for three years with the Fayetteville-Cumberland Human Relations Department.
