City of Fayetteville to mediate Fire Station No. 4 lawsuit

Parties have a year to refile lawsuit if mediation fails
FAYETTEVILLE, NC – The City of Fayetteville’s lawsuit against Fire Station No. 4 contractor W.B. Brawley will head toward mediation following the lawsuit’s dismissal last week. All parties in the lawsuit have negotiated an agreement allowing all parties to dismiss their claims to participate in a mediation. The dismissal comes after the Fayetteville City Council voted to accept a report from engineering firm Applied Building Sciences (ABS), which recommended complete demolition to allow for reconstruction.
The City filed the lawsuit against Brawley for repeatedly performing defective work and refusing to correct the work, among other things, on Fire Station No. 4. The City also sued Travelers Casualty and Surety Company of America (Travelers) for breaching its bond obligations owed to the City. Construction began on the building in 2022.
Following last week’s City Council vote, the City will continue gathering necessary information - including estimated costs for a demolition and rebuild – in order to determine appropriate damages. In the event mediation fails, all parties have up to one year to refile their claims in another lawsuit.
The new location for Fire Station No. 4 is located on Bragg Boulevard at Villagio Place. The building was designed to replace an aging facility and improve emergency response times for about 5,000 homes in the area.
