FAYETTEVILLE, N.C. - The Fayetteville City Council met Aug. 25 in the city hall for their City Council regular meeting to discuss matters relevant to the city.


ANNOUNCEMENTS & RECOGNITIONS

Dr. Hank Parfitt, President Emeritus, Lafayette Society presented a bronze commemorative medallion to the city council from Fayetteville’s recent celebration of the 200th anniversary of Lafayette’s Farewell Tour of America. Ms. Carolyn Justice-Hinson, Fayetteville Rotary Club President presented City Council with a unique scarf commemorating Marquis de Lafayette.

Mr. Talique Whitfield gave a brief overview of his organization, the World Mission Society Church of God Fayetteville. Ms. Amphitrite Constantelos Manuel read her poem she wrote about the All-American City over 30 years ago. Mayor Pro Tem Kathy Jensen and Councilman Deno Hondros presented her with a proclamation and City Coin.

Councilman D.J. Haire presented a Certificate of Excellence and City Coin to Stephanie Kegler, Founder of Dancing Without Sin, in recognition of her dedication to promoting fitness and healthy living.

Councilwoman Lynne Greene presented a proclamation to the parents of the late Stacey Park Milbern. Ms. Milbern was a disability rights activist and is the first Korean American to appear on U.S. currency.

Councilwoman Greene also presented a proclamation to Ms. Angela Tatum Malloy in honor of Black Breastfeeding Week.

Mayor Mitch Colvin and Mayor Pro Tem Jensen presented the City Key and Coin to Ms. Stacey Buckner, Founder and Executive Director of Off-Road Outreach and a 2023 CNN Hero, in grateful recognition of her devoted interest and unwavering commitment to the Community.


CITY MANAGER REPORT

During the city manager’s report, City Manager Douglas J. Hewett highlighted Development Services Director Dr. Gerald Newton presenting to the Fort Bragg Regional Land Use Advisory Commission last week, where he continues to teach military veterans and the City’s Senior Leadership Team. He also shared with council and the audience that Mr. Marcus Townsend, Solutions Architect with the IT department, became a Certified Government Digital Services Professional from The National Association of Government Web Professionals. Mr. Townsend has served more than 20-year with the City of Fayetteville.

Dr. Hewett invited council and the audience to attend the next Fayetteville OutFront meeting at Senior Center East, 917 Washington Drive, this Thursday, August 28 at 6:30 p.m. This meeting will highlight the importance of permits. He also reminded Council and residents that Monday, Sept. 1 is a holiday and solid waste schedule will be altered. Solid Waste services usually collected Monday, will be collected on Wednesday. Recycling will be collected as usual. The meeting agenda was then approved unanimously along with the consent agenda.

7.0A1 Council approved the meeting minutes from:

7.0A2 Council adopted of a comprehensive city-wide loitering ordinance.

7.0A3 Council adopted a resolution authorizing the City Manager to lease a portion of its property located at 472 Hay Street to Subway Real Estate Corp.

7.0A4 Council approved demolition ordinances for three residential buildings deemed dangerous and one blight: 408 Ingram Street 832 East Orange Street 806 Serro Drive 818 Rembrandt Drive

7.0A5 Council adopted a proposed resolution rescinding the demolition ordinance for 3121 Fort Bragg Road.

7.0A6 Council adopted ordinances amending Article 24 (Streets and Sidewalks) of the City Code of Ordinances to address sidewalk exemptions related to driveway permits.

7.0A7 Council approved awarding and authorized the City Manager to execute a $4,604,169.65 contract with Highland Paving Co., LLC, the lowest responsive and responsible bidder, for the FY26 Powell Bill Resurfacing of Various Streets.

7.0A8 Council authorized execution of a $1,000,000 professional services contract with Freese and Nichols for survey data collection of the City’s Municipal Separate Storm Sewer System (MS4), supporting the City’s NPDES Permit requirement to develop, update, and maintain an inventory of MS4 components.

7.0A9 Council adopted Capital Project Ordinance Amendment 2024-1 reflect the reimbursement funding amount associated with NCDOT.

7.0A10 Council adopted Capital Project Ordinance Amendment (CPOA) 2019-21 and Special Revenue Fund Project Ordinance Amendment (SROA) 2019-7 to transfer $40,000 in Federal Transit Administration (FTA) grant funds from the Transit Special Revenue Fund to the Transit Capital Project Fund and appropriate $10,000 in required local match funds.

7.0A11 Council adopted Capital Project Ordinance 2026-8 appropriating $732,280 for radio core upgrades and subsequently approved an amendment to appropriate an additional $269,091 from the General Fund to cover the total project cost of $1,001,371.

7.0A12 Council approved the bid recommendation to award a $275,000 contract to Turbine Service, Ltd. of Saratoga Springs, NY, the lowest responsive and responsible bidder, for one (1) additional Stator Vane Kit, and authorized the CEO and General Manager of the Fayetteville Public Works Commission to execute the contract.

7.0A13 Council adopted a Preliminary Resolution authorizing the filing of an application with the Local Government Commission, requesting that the Commission sell bonds at a competitive sale, and approving the financing team in connection with the issuance of Series 2025 Revenue Bonds for projects totaling approximately $163,000,000 and the refunding of up to $67,000,000 of Series 2016 Bonds, for an aggregate principal amount not to exceed $230,000,000.


STAFF REPORTS

8.01 Council unanimously accepted the Fayetteville Police Department 2025 Second Quarter Review presented by Police Chief Roberto E. Bryan Jr.

8.02 Council unanimously accepted the Fayetteville Fire Department 2025 Second Quarter Review presented by Fire Chief Kevin Dove.


PUBLIC HEARINGS

9.01 The first public hearing Council heard was to request to rezone 2211 Rosehill Road, consisting of 21.27 acres and owned by Cross Creek Refuse LLC, from Single Family Residential 6 (SF-6) to Mixed Residential 5 (MR-5). Council approved to table this item until the regular Council Meeting on Oct. 27. Councilman Mario Benavente voted in opposition.

9.02 The second hearing Council heard was a request to rezone a 2.1-acre parcel on the northwest corner of the intersection of McArthur Road and Stacy Weaver Drive from Single-Family Residential 10 (SF-10) to Limited Commercial Conditional Zoning (LC/CZ) to facilitate redevelopment of the property as a convenience store with fuel sales. Council approved the map amendment to LC/CZ, based on the following findings: The proposed zoning change aligns with the Future Land Use Plan and the Unified Development Ordinance (UDO). Mayor Colvin, Mayor Pro Tem Jensen and Councilman Benavente voted in opposition.

9.03 Council adopted the proposed annexation ordinance for City-owned property at 430 Carvers Falls Road, consistent with the Future Land Use Map & Plan designating the area for Low Density Residential and Office/Institutional development, with an effective date of Aug. 25.


EVIDENTIARY HEARINGS

10.01 An evidentiary hearing was held for a Special Use Permit request a reduction in the 250-foot separation standards between an automotive wrecker service and residentially zoned property located at 3003, 3005, 3009 Murchison Road. Council unanimously approved the Special Use Permit to subject to the submitted site plans and compliance with the current Unified Development Ordinance standards, based on the City’s development code and evidence presented during the hearing.
