FAYETTEVILLE, N.C. - The Fayetteville City Council met Feb. 9, at 6:30 p.m. in the City Hall Council Chambers for their regular council meeting to discuss matters relevant for the City and its residents.
ANNOUNCEMENTS AND RECOGNITIONS
- Council Member Antiono Jones presented Certificates of Excellence to the E.E. Smith Swim Team and Coach for winning the Eastern Sandhill Conference Championship.
- Council Member D.J. Haire presented a plaque to the Fayetteville Guard 6U Titans for their national championship win.
- Council Member Haire also read a proclamation in honor of Dr. Aaron Johnson for his leadership and service.
- Mayor Mitch Colvin extended warm wishes to everyone in celebration of Black History.
CITY MANAGER REPORT
During the City Manager’s Report, Dr. Douglas Hewett, City Manager, invited residents and community partners to the upcoming Murchison Choice Neighborhood Initiative. The meeting is scheduled for Thursday, Feb. 12, at Senior Center East, 917 Washington Drive. Dr. Hewett also shared that the City Council will hold a public hearing on Monday, Feb. 23, at 6:30 p.m. to gather public input on a proposed policy allowing residents to request “No Parking” zones in multi-use lanes. He then expressed gratitude to the Fayetteville Fire Department for their swift response in extinguishing the fire at a commercial property on Ramsey Street.
PUBLIC FORUM
- Council then approved the meeting agenda and opened the public forum.
- This is a critical portion of the Regular Council meeting as the city council seeks to have a collaborative resident and business engagement base. This opportunity allows for residents to address the council directly on specific issues in an effort to inform them of their opinions on specific topics.
- Nine speakers spoke at the meeting expressing concerns regarding utility trailer codes, City leadership, the proposed changes to the public forum policy and data centers. One of the speakers requested City partnership and support for a family childcare home housing to workforce pilot program.
CONSENT AGENDA
Council voted unanimously to approve the consent agenda, except for agenda items 8.0A2 Approve City Council Policies Review Committee Recommendations to City Council Policies 120.09, 8.0A3 Approve Ordinances for Uninhabitable Structures: Demolition Recommendations (484 Tacoma Ct. and 905 Anarine Rd.) and 8.0A6 Authorization to Apply for Fiscal Year 2025 Choice Neighborhood Implementation Grant and Appropriate Additional Funding for the Application. These were pulled for the City Council to vote separately from consent.

- 8.0A2 Council approved rescinding Policy 165.3 and adopting Policy 160.10, establishing updated procedures and responsibilities for school speed zones in accordance with state law and NCDOT standards.
- 8.0A3 Council approved demolition ordinances the following structures that were determined to be dangerous:
- 511 S Eastern Boulevard
- 3634 Thorndike Drive
- 8.0A4 Council authorized the execution of a $1,827,735 engineering services contract with Hazen & Sawyer for the design of the Arran Lakes West Dam Overtopping Protection Project. The project, funded through the Stormwater Enterprise Fund, advances efforts identified in the Beaver Creek 3 Watershed Study to address potential changes in stormwater flow and protect the high-hazard dam and roadway from overtopping.
- 8.0A5 Council approved FAST’s 2026 Public Transportation Agency Safety Plan (PTASP) update to ensure compliance with updated federal safety regulations and maintain eligibility for federal transit funding. The annual update includes 2025 safety data, enhanced safety performance measures and strategies to reduce risks.
- 8.0A7 Council approved a $674,000 contract with K & C Contractors, Inc. to convert six aging tennis courts at Tokay Park into three tennis courts and ten pickleball courts, responding to growing community demand. The project is a partnership between the Economic and Community Development Department and Parks and Recreation, funded through the Community Development Block Grant program, and will improve safety, accessibility, and overall playability.
- 8.0A8 Council approved authorizing the City Manager to negotiate and enter into a contract with Swinerton for pre-construction services as the Construction Manager at Risk for the Fire Station No. 9 Relocation project. The facility on is expected to be approximately 13,000 square feet and is part of the 2022 $60 million Public Safety Bond. It will enhance fire response capabilities with modern apparatus bays, living quarters and operational space.
- 8.0A9 Council approved the sole source recommendation to purchase spare parts for existing on-load tap changers from Reinhausen Manufacturing, Inc, the sole provider in North Carolina, in the amount of $178,691.04, and authorized the CEO and General Manager of the Fayetteville Public Works Commission to execute for that purpose the contract for its purchase.
- 8.0A10 Council approved the sole source request to purchase Distribution Transformers (Overhead, Single-Phase Padmount, and Three-Phase Padmount) from ERMCO (Electric Research Manufacturing Company) of Dyersburg, Tennessee, in the amount of $690,155.00, and authorized the CEO/General Manager of the Fayetteville Public Works Commission to execute for that purpose the contract for its purchase.
- 8.0A11 Council approved the award for the purchase of Gas Turbine 6 IR Load Gearbox Parts and Repair to Philadelphia Gear Corporation, Huetown, AL, the lowest responsive and responsible bidder, and in the best interest of PWC, in the total amount of $529,997.00, and authorized the CEO and General Manager of the Fayetteville Public Works Commission to execute for that purpose the contract for its purchase.
- 8.0A12 Council approved the award recommendation for purchase of BABA Galvanized Steel Transmission Poles to M. D. Henry Co., Inc., Pelham, AL, the lowest responsive, responsible bidder and in the best interests of PWC in the total amount of $3,265,995.00, and authorized the CEO/General Manager of the Fayetteville Public Works Commission to execute for that purpose the contract for its purchase.
- 8.0A13 Council approved Fayetteville Public Works Commission’s recommendation to reject non-conforming bids for the Switch, Recloser Bypass, Cross Arm Assembly, 3 Phase.
- 8.0A14 Council approved Fayetteville Public Works Commission’s recommendation to reject non-conforming bids for the Three Phase Padmount Transformers.
- 8.0A15 Council approved Fayetteville Public Works Commission’s recommendation to reject non-conforming bids for the Cable, 1/0 ALCN EPR 25KV, 1/C.
- 8.0A16 Council approved Fayetteville Public Works Commission’s recommendation to reject non-conforming bids for the Cable, 1/0 ALCN EPR 25KV, 1/C.
- 8.0A17 Council approved Piedmont Natural Gas Company, Inc.’s request for a permanent pipeline easement, temporary construction easements, and a revocable license agreement on City-owned property managed by the Fayetteville Public Works Commission.
- 8.0A18 Council approved the Preliminary Assessment Resolution to move forward with providing sanitary sewer service to Area 30 of the Phase 5 Annexation. Adoption of the resolution allows required notices from the Fayetteville Public Works Commission to be issued to affected property owners and schedules a public hearing for March 23, 2026, regarding the proposed utility improvements and related assessments.
- 8.0A19 Council approved the Preliminary Assessment Resolution as part of the statutory process to extend sanitary sewer service to Area 30 of the Phase 5 Annexation. The action authorizes required notifications from the Fayetteville Public Works Commission to affected property owners and sets a public hearing for March 23, 2026, to consider the proposed improvements and related assessments.
- 8.0A20 Council approved the Preliminary Assessment Resolution required to extend sanitary sewer service to Area 31 of the Phase 5 Annexation. The action allows for notification of affected property owners and sets a public hearing for March 23, 2026, to review the proposed utility improvements and related assessments.
ITEMS PULLED FROM CONSENT
- 8.0B2 Council voted to amend City Council Policy 120.09, changing the Work Session start time from 2 p.m. to 3 p.m. Announcements and recognitions will now be included in the Work Session and will begin at 6:15 p.m., followed immediately by the public forum, with a 5 p.m. deadline to sign up for public comment.
- 8.0B3 Council approved the demolition ordinances of two uninhabitable structures deemed dangerous, 484 Tacoma Court and 905 Anarine Road, with a 60-day stay before demolition.
- 8.0B6 Council authorized staff to apply for the Fiscal Year 2025 Choice Neighborhood Implementation Grant for the Murchison Road area and approved related budget amendments to fund grant preparation activities. The grant will support redevelopment of Elliot Circle and Murchison Townhomes, providing mixed-income housing, neighborhood improvements and programs to enhance education, health, and economic opportunities for residents.
REPORTS FROM BOARDS AND COMMISSIONS
- 9.01 Council received the Fayetteville Advisory Committee on Transit (FACT) Annual Report, presented by Chair Austin Campbell. FACT serves as an advisory body to FAST leadership and City Council, providing recommendations to improve Fayetteville’s transit system and address the community’s current and future public transportation needs.
STAFF REPORTS
- 10.01 Council adopted the 2026 State Action Plan, which aligns with all City Council strategic goals and objectives. The plan guides Fayetteville’s state-level advocacy, prioritizing economic development, infrastructure and transportation improvements, public safety, support for the military and overall quality of life, and will be used to communicate and coordinate with state lawmakers and agencies.
- 10.02 Council adopted the 2026 Federal Action Plan, guiding Fayetteville’s advocacy with federal legislators and agencies to advance Council priorities. The plan focuses on workforce growth, economic development, housing and infrastructure, veteran and military support, mental health and community safety, ensuring the City can protect resources, expand services and improve residents’ quality of life.
PUBLIC HEARINGS
Council conducted one public hearing during this meeting.
- 11.01 The public hearing was held regarding a request to remove a residential parcel at 220 Hugh Shelton Loop from the Downtown Municipal Service District (MSD).
There were three speakers for the removal from the MSD.
Council voted to send this item to the Policy Committee to develop a policy regarding the removal of the parcel from the Downtown Municipal Service District.
OTHER ITEMS OF BUSINESS
- 12.01 Council received the Applied Building Sciences report on Fire Station #4, presented by Steve Moore, a consultant. Council directed staff to return with additional information on next steps based on the findings and recommendations.
- 12.02 Council received a briefing on the UNC Charlotte Urban Institute’s final findings from the Cost of Gun Violence Study.
